Now Hiring!

You may have seen on the news this week that Supreme Court Justice, Antonin Scalia died Saturday, February 13th.  He was 79 years old, and the longest serving member of the current court, having been nominated by President Reagan in 1986.  Immediately (like, literally within seconds) of his death the focus became focused not on his legacy, but on who would be nominated to serve in his place.  I’ve never been a big fan of most of Justice Scalia’s opinions on the Court, but even I thought the immediate politicization of his death was kind of distasteful.

Nevertheless, since we will be studying the Supreme Court next week, I’ve decided to go ahead and blog about what it sure to be a hotly contested debate in the upcoming weeks.  Article II, Section 2 of the Constitution states, “[The President] shall nominate, and by and with the Advice and Consent of the Senate, shall appoint…Judges of the Supreme Court.”  The President has always nominated an individual for the Court, and the Senate rejects or confirms them after going through a lengthy confirmation hearing in which they interview the candidate about their background, choices, and legal opinions.  This process is designed to provide the “checks and balances” we have discussed in class.  Both the President and the Senate have important roles in choosing our next Supreme Court Justice.
So what’s causing all the controversy?  There are 9 Supreme Court Justices – currently 4 of them are considered to be more liberal on issues, and the other 5 (before Scalia’s passing) are more moderate and conservative. Justice Scalia was by all accounts a more conservative justice – perhaps one of the most conservative on the bench.  With his passing, President Obama has the potential to nominate a more liberal justice, which will effectively shift the political leanings of the Court – giving the liberal justices a majority for the first time in years.

Many outspoken conservatives are calling on President Obama to withhold his nomination, and allow the incoming President to nominate someone after the election.  Some Republican Senators have said they will take no action on confirming anyone President Obama nominates.  For his part, President Obama has said the Constitution is clear, it’s his responsibility to nominate someone, and he plans to do so.   

So my question to you this week is twofold, First, “Do you think President Obama should nominate someone for the Supreme Court, or should we wait until after the election for the incoming President to do so?”  Second, “If you sat on the Supreme Court, what is one issue that you would like to issue a ruling on – and what would be your opinion?”  You must answer both questions for full credit.  Answers are due no later than Wednesday, February 24th, 2016.

  1. Yes, I think Obama should nominate someone. He is only doing what the law clearly states (Article 2 section 2). Why wait it should be a big dual or something. announce the president and announce the nomination for the supreme court.That actually would be awesome! Any who, if i sat on the supreme court, my issue that i would want to rule is bringing prayer back in the schools. I just think when the government took prayer out everything just seem to spiral down hill. Now we trying to figure out what to do. "Bring Prayer Back"

  2. President Obama should elect someone because its his job. If i sat in the bench i would want to rule on legalizing Marijuana at a federal level. I would legalize it and tax it highly to get money for more important things in the state and federal level.

  3. I do think the Obama should nominate someone it is in the Constitution that it is his job. I would have to say that if I sat on the bench I agree with Kevin. I would also say that I would legalize marijuana at the federal level. I think that would bring in a great amount of revenue that is needed. That is money that could go towards things that would benefit the people. I also looked up a few cases that are going on right now and one of them really caught my eye. It is Riley V. California. It is about cell phones being searched by the police without a warrant. On that case I would have to say that I do think that police should have to have a search warrant to look through your phone. It is no different to me than your house or your car. They should not be allowed to walk up to anyone a say give me your phone I want to look through it. It should be obtain by them through a legal avenue.

  4. I think that president Obama should elect someone, I think he would choose a respectable person, someone with the right intentions, i'm guessing. If I sat on the Supreme Court, I would Jesus's commandments and Laws , and teachings back in the work. We would follow them. I chose the because the world would be a better place by doing so.

  5. Yes, I think President Obama should elect someone else. It's in his rights as President. If I was apart of the supreme court I would also pick legalizing marijuana. I feel that we could benefit from the profits that we would make from it. I would also vote for something protecting the environment.

  6. I don't think president Obama should nominate somebody for the supreme court because we may go back to being republican and that doesn't make sense when its about to be a new president. One issue that I would like to issue a ruling on in the supreme court is he limitations of being a ex felon or criminal. I don't think its fair for a person to not be able to get a job, apartment, house, car etc because they were once a felon or been a criminal in the past. Everybody make mistake and people can change especially if the felon was petty and old such as a battery from fighting a person ten years ago. This is the reason why most people turn back to crime and are still living in the poverty zone.

  7. Obama is still president. He can still choose who can be on supreme court. He is still in authority to make those descions. If I sit on the supreme court a issue I would address would be the police brutality and violence. I think its out of hand and wrong. Amber Pierre

  8. Obama is the president of America so yes I believe he has all rights to elect the next Supreme Court Justice. Until the next president is in office he still has duties he wishes to fulfill. If I sat on the supreme court I would address education. I feel that not enough kids are being taught at the level needed to help them see what they want to do in the future. Ever since I came to college I heard how schools are closing down back in my home town and I know school can be tough be we need to learn. How else are younger people going to be able to change things if they don't learn what out there.

  9. I believe that Obama should be able to pick someone for the supreme court because he is still president and still has a say so in what is going on. One problem that I would focus on is police brutality because it is a problem that bothers me and that is a becoming a huge problem.

  10. As our President stated its clearly written in the Constitution that it is his choice and decision. So yes I feel he should appoint the Supreme Court Judge to sit in his seat. One issue I would address but I have many, I would address how some employees short change non violent convicted felons on there hourly pay on a job! I feel that non violent felons should receive a fair hourly pay wage. It's so unfair that these men or women don't get a second chance in life, even if their well educated with degrees and trades under their belt. Like I said some employees not all, I would rule on increased pay wage to all employees. Especially the ones that sold drugs to make ends meet. I feel without a good start could ultimately end up in a bad decision and land them right back to prison, (I know a poor choice and decision)but these people do not have a lot of faith in our work force nor much faith in their selves either. Employees should offer life skill classes for those less fortunate ones who don't have role models or that go to person to encourage them to move forward and know that when one door closes another will open!

  11. If it says it in the constitution then that is what should be followed, Obama is current president and that is his responsibility and his job. If I were on supreme Court, I am not entirely sure what one issue since there are so many. I suppose it would be education, consider that our children will inherit out debt (not just money) and they need to be taught how to see these problems and learn to work together to find a solution. I know there are more important issues, but I hate seeing and hearing what kids are learning currently. It is terrifying hearing my niece (who is fairly smart with a good head on her shoulders) tell me not to use the word "savage" because "that's all everyone says" but has no clue as to what it means or bother to use context clue to figure it out.

  12. I say we should wait until the next election. As for the issue, I would say to band same sex marriage and to band poaching or hunting endangered or "at high risk" animals. The reason being that I obviously don't approve either one of these. It should be wrong to do so. I don't care if people hate me because we have all survived WITHOUT same sex marriage for many many years. In other countries people would be put to breath because of that and now that we have legalized it, think what the other countries think about us.

  13. opps few hours late...if it is his duty then he should nomintae someone...after all they senate does not have to accept them...if i was a supreme court judge, i would be against the smoking inside of public buildings law it is super annoying when it is cold outside...

  15. I personally think that president Obama should elect someone because it is his job to do so. If i sat in the bench i would want to talk about legalizing Marijuana. Like Kevin stated, at a federal level. I would legalize it and tax it not too high but high enough to get money for more important things in the state that actually need the money. There are other things that i would rule on as well but that, to me, is the most important at the moment.

  16. I think Obama should still be able to elect someone for the Supreme Court. I would talk about gun control and discrimination because they always end up in the same situations this has been a problem for a long time and people should pay attention to this subject.

  17. 1. I feel as though Obama and another group of individuals should be allowed to elect someone for the Supreme Court. I don't think that it's necessarily fair for just Obama to elect someone who's going to be in a long term job like that. Compared to how long the president stays in office to the Supreme Court I think that it should be done by the President but also a group that's been there for a long term time.
    2. If I sat on the bench, I would bring up issues like women's healthcare and Planned Parenthood. How we need PP, and access to better female healthcare.

  19. I think Obama should be able to elect someone for the Supreme court. As of something i would want to talk about during part of Supreme court would have to be gun control. There are to many high power rifles.

  20. If I were Obama I would try and nominate someone. I would want to talk about the issues of police violence and equality issues including salary in the work place.
